DRAFT Minutes of the Planning Committee held in the Trust Room on Tuesday 29th March 2011 at 7.30 pm
PRESENT: 6 Councillors: Cllr. P.Pudduck (Chairman), Cllr. J. Ferris, Cllr. A. Lovell, Cllr. H. Newcombe Cllr. G. Sowerby and Cllr. K. Sowerby. Mrs. E Illingworth (Clerk) was also present.
P/032/11 APOLOGIES FOR ABSENCE (1)
Apologies were received from Cllrs Hacking, Henshall and Pithers.
P/033/11 MINUTES (2)
The Minutes of the Planning Committee Meeting held on Tuesday 8th March 2011 were signed as a correct record.

P/036/11 PLANNING APPLICATIONS (5)
1. 30/0635/11/F Resubmission of householder application reference 30/2790/10/F for alterations and extension to dwelling for Mr D White at Beechwood, Higher Contour Road, Kingswear. TQ6 0DE. NO OBJECTION (5 no objection, 1 abstention) Comment: All new windows to be consistent with existing windows of original building in size.
2. 30/0648/11/F Householder application for proposed alterations and extension and new 2nd floor for Mr and Mrs M Petri at 10 College View Fore Street, Kingswear. TQ6 0AJ. NO OBJECTION (unanimous)
3. 30/0554/11/F Construction of three 2-bedroomed flats with 5 car spaces for Mr R Morrison at Plot 4 Lower Contour Road, Kingswear. OBJECTION (Unanimous)
Reasons: It is felt there is too much glass in the design. Existing properties have space between windows. There will be a loss of parking. The committee were in favour, in principle of the original Architect plan 2367.02 for a single dwelling.
4. 30/0602/11/F Alterations to provide 3 no garages, studio over, lift and conversion to two dwellings for Mr and Mrs Hiscox at Wayside, Lower Contour Road, Kingswear. TQ6 0AL. OBJECTION (Unanimous) Reasons: The committee were happy with the internal alterations however the garages are overdevelopment and out of character. The external design was felt to give a beach hut appearance. Parking spaces would be taken up.
P/037/11 TPO MATTERS (6)
1. Work to Tree Preservation Order Trees. Register Number of Notice: 3137. Planning ref: 30/0542/11/TW. Site; The Maples, Mount Ridley Road, Kingswear. NO OBJECTION
2. Serving of New Order. Tree Preservation Order 2011. Putts Reservoir, Upper Wood Lane, Kingswear. SUPPORTED
P/038/11 ITEMS OF CORRESPONDENCE REQUIRING ATTENTION (7)
1. Correspondence from Tree Warden re Tree work at Beacon Lodge, Kingswear. Notice 3131. Noted
2. Kingswear Conservation area consultation. Councillors have had the opportunity to examine the draft Conservation area appraisal as well as receiving feedback from members of public, which has been very helpful. It was agreed to ask for an extension to the Conservation Area to include The Mount, Ridley House and Mulberry House, as they are substantial older properties with large gardens and of historical value, in keeping with the original village. It was thought that the documentation produced was very well presented and helpful. These comments will be feed back to the Conservation and Design Officer.
Urgent Items
Two were agreed by the Chairman:
1. The recommendation of a grant of approval for three years for Greenway House to hold civil marriage ceremonies and civil partnership registrations/ceremonies.
There has been some concern over the numbers of people attending a ceremony and the traffic implications. Cllr. Newcombe has spoken with the National Trust who has advised that the numbers will be limited to 30 attendees and there were be no reception held afterwards, just the ceremony itself. It was agreed for Cllr Newcombe to request this in writing and for the clerk to write to Devon County Council in response to the Legal Notice in the Herald Express with no objection, but with a request for more information about the licence granted and the numbers involved. The item is also to be placed on the full council agenda in April (19th).
2. Consultation invitation concerning mixed use development at White Rock, Paignton. (Outline Planning)
This development proposes 350 dwellings as well as employment, local centre/food retail, student accommodation, open spaces, sports pavilion, associated infrastructure, access, drainage and landscaping at land west of Brixham Road, Paignton. SHDC ref P OST 02501.
The committee, after discussion, instructed the clerk to respond to the consultation stating that Kingswear is dependent on the Brixham Road and to request a feasibility study be conducted on the impact of the additional traffic aswell as the effect on the infrastructure and tourism of the area.
